Podcast Guest Release & Appearance Agreement

1. Consent to Record and Participate
I, the undersigned Guest, voluntarily agree to participate as a guest on the podcast “Within the Present Moment” produced by Omarian Atman Studios LLC (“Producer”). I consent to the recording of my voice, image (if video), statements, interview, and any other performance or contribution (collectively, the “Recording”).

2. Grant of Rights
I hereby irrevocably grant to Producer, its successors, assigns, licensees, and agents a perpetual, worldwide, royalty-free, fully paid-up, non-exclusive license to:

  • Record, edit, modify, adapt, create derivative works from, reproduce, distribute, publicly perform, display, stream, podcast, broadcast, and otherwise use and exploit the Recording in any manner and in any media now known or hereafter devised.

  • Use my name, likeness, voice, image, biographical information, and any statements I make in connection with the promotion, marketing, advertising, and distribution of the podcast and related content.

  • Distribute the episode on platforms including (but not limited to) Apple Podcasts, Spotify, YouTube, websites, social media, and any other current or future distribution channels.

  • Repurpose the content into clips, highlights, video podcasts, transcripts, blog posts, marketing materials, AI-assisted content, merchandise, or any other formats.

I understand that the Producer has no obligation to use or publish the Recording and may edit it at its sole discretion.

3. Ownership
The Producer owns all rights, title, and interest in the final edited episode and any derivative works. I retain ownership of any pre-existing materials I provide, but grant Producer a license to use them as part of the episode.

4. Release and Waiver
I release and forever discharge Producer, its owners (including Omarian Atman), employees, contractors, affiliates, and agents from any and all claims, demands, or liabilities arising from the use of the Recording, including but not limited to claims for invasion of privacy, defamation, right of publicity, copyright infringement, or any other personal or proprietary rights.

5. Confidentiality (Optional – if sensitive topics are discussed)
I agree to keep confidential any non-public information shared by the Producer during preparation or recording, unless otherwise agreed in writing.

6. Representations and Warranties
I represent that:

  • I am at least 18 years of age (or a parent/guardian signing on behalf of a minor).

  • My participation and statements do not infringe any third-party rights.

  • I have the full authority to grant the rights in this Agreement.

7. No Compensation
I understand that I will not receive any monetary compensation for my appearance, unless a separate written agreement is made.

8. Governing Law
This Agreement is governed by the laws of the State of Utah, United States. Any disputes shall be resolved in the courts of Iron County, Utah.

9. Entire Agreement
This document constitutes the entire agreement and supersedes any prior understandings.
